Terms of Use

The agreement for using Mexerica: Berga, your bots, your Hub and what is up to each side.

Effective from November 1, 2026 · Updated November 7, 2026

This English version is a translation provided for convenience. If it differs from the Portuguese version, the Portuguese version prevails.

1. Acceptance

These Terms of Use are an agreement between GUILHERME VASQUES LTDA, Brazilian taxpayer ID (CNPJ) 62.441.139/0001-28 (“MEXERICA”, “we”), and whoever installs or uses Mexerica or creates an account (“you”). By using the app, the Hub or the account (the “Service”), you accept these terms and the Privacy Policy.

To use the Service, you must be at least 18 years old and able to enter into contracts. If you use the Service on behalf of a company, you represent that you can act for it.

2. The Service

Mexerica is free software for creating and running a team of AI agents, led by Berga. The app and the Hub run on the computer or server you choose, and you can connect more than one computer to the same Hub. That is where conversations, memories, skills, files and bots live.

Our cloud is optional and is only used for the account, for connecting your devices and computers to your Hub, and for delivering your routines’ external triggers (webhooks) to the Hub. The Service is under development: features may change, be limited or be removed. Where possible, we will give notice before removing something you depend on.

3. Your account

You are responsible for keeping your details accurate and your credentials safe, and for everything that happens in your account. If you sign in with Google or another provider, that sign-in also follows the provider’s terms. Tell us at support@mexerica.app if you suspect your account, a device, a computer or your Hub has been compromised.

4. Your Hub, your computers and your costs

The Hub runs in your environment: on your computer, your server or a machine you rent from a third party. You are responsible for:

5. Bots and AI answers

Berga and the other bots act with the instructions, permissions, accounts and apps you give them, and may hand tasks to each other within those limits. What a bot does within those permissions is done on your behalf. This includes messages sent (including over WhatsApp), files changed, commands run and data read or deleted. When the Service asks for your approval before an action, the decision to approve is yours.

AI can be wrong, incomplete or out of date, even when it sounds confident. Review the result before relying on it. Do not use the bots as a substitute for professional advice (legal, medical, financial or other), or as the only basis for important decisions about people.

6. Acceptable use

You may not use the Service, or let the bots be used, to:

We may suspend access to our cloud if a use threatens the security of the Service or of others. Where possible, we will warn you first.

7. Your content

What you put into the Service and what your bots produce is yours, subject to the terms of the AI provider that generated it. That content stays in your Hub. Our cloud only carries, encrypted, what travels between your devices, your computers and your Hub, plus your routines’ external triggers, which it encrypts on arrival and delivers to the Hub without storing, as described in the Privacy Policy. We do not use your content to train models.

8. AI providers, apps and WhatsApp

Bots use third-party models (such as Anthropic, OpenAI, Google and xAI) through the engine you already use, with your accounts or keys. That use also follows your agreement with each provider, and you are responsible for complying with its terms and for its charges.

Connected apps and MCP servers give bots access to other services. The WhatsApp number you connect to a bot follows Meta’s terms. These services belong to third parties and follow their own terms. Their availability and what they do with data are outside our control.

9. Free of charge

The Service is free today and there are no payments. If that changes, prices and conditions will be announced beforehand, and nothing will be charged unless you expressly sign up for it.

10. Intellectual property and licenses

The app and the Hub are distributed by MEXERICA. You receive a free, non-exclusive, non-transferable and revocable license to install and use the software under these terms, for yourself or for the company you represent. The Mexerica brand, Berga, the mascot, the software, the design and this site belong to MEXERICA or its licensors.

The software includes third-party components, each under its own license. Those license notices ship with the software. Beyond what those licenses or the law allow, you may not copy, modify, resell or redistribute the software. Suggestions you send us may be used without any obligation to you.

11. Availability

The Service is provided “as is” and “as available”, to the extent the law allows. We do not guarantee it will work without interruptions or errors, or that it fits a particular purpose. Our cloud may go down. If it does, remote access and external triggers stop, but the Hub keeps running in your environment.

12. Limitation of liability

To the extent the law allows, we are not liable for indirect damages, lost profits, or loss of data or revenue. We are also not liable for damages caused by:

Nothing in these terms removes rights the law does not allow to be limited, including those under Brazil’s Consumer Protection Code, where it applies.

13. Suspension and termination

You can stop using the Service and delete your account at any time. To delete it, use your account page (accounts.mexerica.app/user) or write to support@mexerica.app. We may suspend or close your account for a material breach of these terms or if the law requires it. If the Service is discontinued, we will give reasonable notice. Your Hub’s content stays in your environment, under your control.

14. Changes to these terms

We may update these terms. Relevant changes will be announced before they take effect, by email or in the app. Continuing to use the Service after that means you accept the new version. The current version is always on this page.

15. Governing law and venue

These terms are governed by Brazilian law, and the Portuguese version prevails over any translation. The courts of the District of Umuarama, Paraná, Brazil, are chosen as the venue. If you are a consumer, you may file suit in the courts of your place of residence.
